THIS RENTAL AGREEMENT is made on this, the 7th day of February, 2012 at DELHI.
BETWEEN
1. Sh. ABC……. S/o Sh. XYZ…….. residing
at A-5, 3RD FLOOR, ABC Nagar New
Delhi 110000, (hereinafter called the “First Party/ Land Lord/ Land Lady”
which term shall mean and include whatever the context so admits and permits
his legal heirs, legal representative, executors, administrators)
AND
1. Mr. RST…….. S/o Mr. HGF…………, permanent resident
of H. N. 100, ABC Nagar, Delhi – 110000 (hereinafter
called the “Second Party/ Tenant).
And whereas the
expression of both parties which shall include their legal heirs, nominees,
next of, successors, administrators etc.
And whereas the First Party is the true, recorded, lawful
owner and in his/ her possession of the property bearing its A-5, 3RD FLOOR, ABC Nagar, NEW
DELHI 110 000.
WHEREAS the FIRST
PARTY herein is the sole and absolute owner of all that piece and parcel of
the residential A-5, 3RD
FLOOR, ABC Nagar, NEW DELHI 110 000.
AND WHEREAS the First Party has
agreed to let out the property No. A-5, 3RD FLOOR, ABC Nagar, NEW
DELHI 110 000 out of the above noted property consisting of Three room, along with
toilet, bath & kitchen with Furnitures & Fittings on monthly rent of
Rs. 7500/- ( Rupees. Seven Thousand and Five hundred only) for a period of
eleven months for the use of residential purposes.
And whereas the tenancy has commenced w.e.f. 07.02.2012
and the tenancy period may extended with the mutual consent of both parties.
And whereas the tenant held liable to pay the
electricity & water charges extra according to the consumption to the first
party/landlord/landlady.
And whereas the tenant/Second party shall not
challenge about the rent in any court of law & pay regularly in time.
The tenant/Second party has paid a security money of
Rs. 7500/- ( Rupees Seven Thousand and Five Hundred only) to the landlord/first
party which will be refundable without interest at the time of vacating the above
said premises.
NOW THIS LEASE AGREEMENT
WITNESSTH AS FOLLOWS:
- That the tenant/Second Party shall not make any addition or alteration in the above noted premises without the written consent of the first party, and shall keep the premises neat and clean and shall not let out the same on rent or without rent to any other person at any time.
- The first party shall be fully entitled to look after the same at reasonable hours and second party/ tenant shall not raise any objection against the same.
- That the Tenant shall pay the rent at the above rate regularly in advance of each English Calendar month on or before 15th day of every month.
- The white washing, painting, day to day repair/ maintenance will be done by the tenant at his/ her own cost and expenses.
- That if the tenant stops the payment of rent, than the First Party/ Landlord/Landlady will be free to initiate legal proceeding for the recovery of al the arrears of the rent and to evict the tenant.
- That the tenancy commence from 07.02.2012 for a period of eleven months and the period of tenancy may be extended by both the parties with their mutual consent.
- That if the first party wants to get the said premises vacated before the expiry of tenancy period from the second party/tenant than he shall produce one month advance notice to the second party/tenant, and tenant shall also adopt the same condition.
- That the tenant shall be abide by all the rules and regulations of the concerned authority.
- That the tenant will use the said premises only for residential purpose only.
- That if any time, tenant shall use the premises for any illegal purposes, or misuse the same in any other manner, the First Party/ landlord/landlady, shall be fully entitled to evict the premises through court of law, without giving any notice to tenant.
- That the tenant hereby assures to the Landlord\Landlady, that he shall pay the rent regularly to the landlord/landlady, and also abide by all the rules and conditions of this Rent Agreement.
- That all the expenses of stamp papers & other documents papers, charges shall be borne by the tenant.
- That this rent will be treated Standard Rent and the tenant or his legal heirs shall not challenge in any court of law in respect of the above rent.
- That the rent will be increased ten percent after the expiry of the tenancy period if renewed for further period by mutual consent of the first party & Second party.
